Increase in directors getting banned!

The insolvency service has reported that there has been a 25% increase in the amount of directors being disqualified.

It seems that the insolvency service is getting tough on rogue directors.

Directors found to have acted in contravention of their fiduciary duties can face disqualification from being a director, acting as receiver of a company’s property or being concerned in or taking part in the promotion, formation or management of a company, for up to 15 years.

One of the consequences of contravening the disqualification order or undertaking is that the individual can be made to be personally liable for debts incurred.

It is important for anybody facing financial difficulties, whether personally, directors of limited companies or partnerships, to seek advice from a licensed insolvency practitioner as soon as possible.
